Participant Liability Waiver, Assumption of Risk, and Release of Liability

This Participant Liability Waiver, Assumption of Risk, and Release of Liability (this “Waiver”) is entered into by the undersigned individual, on behalf of themselves or other individuals who the undersigned individual may register at the other individuals’ request and any minor child(ren) and companion animal(s) accompanying them (collectively, “Participant”), in favor of SiRa Dentistry, its owners, doctors, employees, agents, and representatives, and the Spotswood Fire Department and its officers, employees, and volunteers, together with each event vendor, sponsor, contractor, and subcontractor providing services at the event described below, including without limitation any bounce house/inflatable operator, petting zoo or animal-handling vendor, and food truck or food-service vendor (collectively, the “Released Parties”), in connection with the event described below.
Event: 3rd Annual Pet Halloween Costume Contest, hosted by SiRa Dentistry, benefiting the Spotswood Fire Department (the “Event”)
Date & Time: Friday, October 16, 2026, 5:00 PM–8:00 PM
Location: 456 Main St, Spotswood, NJ 08884—an outdoor venue. Event activities may include, without limitation, an outdoor costume contest and judging, inflatable bounce house(s), a petting zoo or animal-encounter exhibit, food truck vendors, music/amplified sound, and related outdoor entertainment (collectively, the “Activities”).
1. Voluntary Participation
Participant’s attendance at, and participation in, the Event and the Activities is entirely voluntary. Participant confirms that they have chosen to attend and to bring any accompanying pet(s) and/or minor child(ren) of their own free will, and that no one has coerced or pressured Participant to attend.
2. Assumption of Risk
Participant understands and acknowledges that attendance at an outdoor community event involving animals, inflatable amusement equipment, food service vendors, and large gatherings of unfamiliar people and animals carries inherent risks, including but not limited to:
- Bites, scratches, kicks, trips, falls, or other injury caused by any animal present at the Event, including Participant’s own pet, another attendee’s pet, or any animal provided by a petting zoo or animal-handling vendor;
- Injury arising from the use of bounce houses, inflatables, or other amusement equipment, including falls, collisions with other participants, or equipment malfunction;
- Foodborne illness, allergic reaction, burns, or other injury arising from food or beverages purchased or sampled from food truck or food-service vendors;
- Slips, trips, and falls on outdoor or uneven terrain, and exposure to weather conditions, insects, or outdoor hazards;
- Injury or property damage caused by the acts or omissions of other attendees, participants, spectators, or their pets;
- Loss, escape, injury, illness, or death of Participant’s own pet arising from any cause during the Event, including interaction with other animals, environmental stressors, or accidental escape; and
- Any other risk, known or unknown, foreseen or unforeseen, inherent in attending or participating in an outdoor public event of this nature.
Participant voluntarily and knowingly assumes full responsibility for any and all such risks, whether arising from the negligence of the Released Parties or otherwise, to the fullest extent permitted by law.
3. Release and Waiver of Liability
To the fullest extent permitted by applicable law, Participant, on behalf of themselves, their heirs, executors, administrators, and assigns, hereby releases, waives, discharges, and covenants not to sue the Released Parties from any and all liability, claims, demands, actions, and causes of action whatsoever arising out of or related to any loss, damage, illness, personal injury, or death that may occur to Participant, Participant’s minor child(ren), or Participant’s pet(s) as a result of participation in the Event or the Activities, whether such loss, damage, illness, injury, or death is caused by the negligence of the Released Parties or otherwise, except to the extent caused by the gross negligence or willful misconduct of a Released Party.
4. Indemnification
Participant agrees to indemnify and hold harmless the Released Parties from any loss, liability, damage, injury, or cost, including reasonable attorneys’ fees, that any Released Party may incur as a result of: (a) any injury or damage caused by Participant’s pet(s) to another person, animal, or property at the Event; (b) Participant’s breach of this Waiver or of any posted Event rule; or (c) Participant’s negligent or intentional acts or omissions during the Event.
5. Pet-Specific Terms and Owner Responsibilities
By bringing a pet to the Event, Participant represents and warrants that:
- Participant is the legal owner of the pet, or has the owner’s express permission to bring the pet to the Event and to sign this Waiver on the owner’s behalf;
- The pet is current on all required vaccinations, including rabies vaccination, and Participant will provide proof of current vaccination upon request by Event staff;
- The pet has not bitten, attacked, or shown aggression toward any person or animal within the twelve (12) months preceding the Event;
- The pet will remain on a secure, non-retractable leash (or in an appropriate carrier) at all times and under Participant’s direct control throughout the Event; and
- Participant is solely responsible for the conduct, behavior, and welfare of their pet, for immediately cleaning up after their pet, and for any injury, damage, or harm the pet may cause to any person, animal, or property.
SiRa Dentistry and Event staff reserve the right, in their sole discretion, to remove any pet or Participant from the Event without refund or compensation if the pet displays aggressive, dangerous, or disruptive behavior, or if Participant fails to comply with posted Event rules or the reasonable instructions of Event staff or volunteers.
6. Emergency Medical Treatment Authorization
In the event of an injury or medical emergency involving Participant, Participant’s minor child, or Participant’s pet during the Event, Participant authorizes Event staff and on-site emergency personnel to obtain or administer emergency first aid and to arrange for transport to the nearest appropriate medical or veterinary facility if Participant or the pet’s owner cannot immediately be reached. Participant understands that Participant remains solely financially responsible for any medical, hospital, or veterinary expenses incurred.
7. Compliance with Event Rules
Participant agrees to comply with all posted rules, verbal instructions from Event staff and volunteers, and any applicable local ordinances while at the Event, including any rules specific to bounce house use, the petting zoo or animal-encounter area, and food truck vendor lines.
8. Photography and Media
Participant acknowledges that photography, video, and audio recording may occur throughout the Event. A separate Media Consent and Photography/Videography Release governs the use of any such images, video, or recordings for marketing purposes, and Participant should refer to that document for the specific terms of that consent.
9. Severability
If any provision of this Waiver is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect, and the invalid or unenforceable provision shall be modified only to the extent necessary to make it enforceable.
10. Governing Law
This Waiver shall be governed by and construed in accordance with the laws of the State of New Jersey, without regard to its conflict-of-laws principles.
11. Entire Agreement
This Waiver constitutes the entire agreement between Participant and the Released Parties regarding its subject matter and supersedes all prior or contemporaneous understandings, whether written or oral, regarding that subject matter.
BY SIGNING, I CONFIRM THAT I HAVE CAREFULLY READ THIS WAIVER, THAT I FULLY UNDERSTAND ITS TERMS, AND THAT I AM SIGNING IT VOLUNTARILY WITH FULL KNOWLEDGE OF ITS SIGNIFICANCE, INCLUDING THAT I AM WAIVING CERTAIN LEGAL RIGHTS ON BEHALF OF MYSELF, individuals who authorized me to register them, MY MINOR CHILD(REN), AND MY PET(S).
